Union organizers at Bates College are calling on the National Labor Relations Board to count ballots that have been sealed for more than a year.
Bates employees voted in union elections in January 2022. But the ballots have yet to be counted because the school submitted a request to review the structure of the union and its inclusion of all Bates employees and non-tenured faculty.
The previous rule required ballots to be held and forfeited while the board considered the college’s request.
But Jeffrey Young, an attorney representing the organizers, said the NLRB recently announced it would revoke that rule, opening the door to the counting of ballots.
“My understanding is that in two similar cases, the NLRB has already ordered the opening and counting of ballots. We hope they do the same here,” Young said.
Union organizers now have submitted a request with the National Labor Relations Board requesting that the board order the ballots to be opened and counted.
U statementBates President Clayton Spencer said the college objected to a request earlier this month that the regional labor committee director count the ballots.
“We opposed this request because, among other things, it is unclear whether the rule change applies retroactively to cases, such as ours, that are already pending before the Board or applies only to future cases.”
“Furthermore, since our case calls into question how the bargaining unit—and thus the voting unit or units—is defined, opening the ballots before the full committee in Washington has ruled on the basic question of whether is the appropriate unit is particularly problematic in this case. case,” Spencer wrote in a letter to employees.
Spencer added that she recognized the “frustration of union-eligible employees, regardless of how you voted,” because she does not yet know the final outcome of the union vote.
